New York State Department of Labor policy on issuing certificates to people whose refresher training is over 12 months since previous training:

In order for trainees to comply with the annual refresher training requirement, the Department of Labor will accept training that was taken no later than 30 days past the expiration date of a DOH-2832. The following are three examples:

 

Example 1

The trainee in example 1 could apply today for DOL certification.

Example 2

Handler Refresher 6/3/04

The trainee in example 2 could apply today for DOL certification as he/she is within the 30-day grace period allowed by DOL.

Example 3

The trainee in example 3 did not complete annual refresher training within the 30-day period allowed by DOL. The NYS Dept. of Labor will reject the application. The student will be required to follow the instructions contained in DOL’s rejection notice in order to receive further consideration. The DOL will likely require that the applicant complete another applicable refresher training program.

 

It is imperative that students understand that annual refresher training is required in order to maintain certification with the Department of Labor. Furthermore, a student that does not comply with this requirement should not be directed to this office for a Department of Health "equivalency".
