A09485 Memo: TITLE OF BILL : An act to amend the education law, in relation to
prohibiting the purchase or use of certain urinal or toilet
deodorizers in school buildings
PURPOSE : To prohibit the purchase and use of urinal or toilet
deodorizers containing paradichlorobenzene by public and private,
elementary and secondary schools.
SUMMARY OF PROVISIONS : Section One: The Education Law is amended by
adding a new section 409-g to ban the purchase or use of urinal or
toilet deodorizers containing paradichlorobenzene for public and
private schools.
Section Two: Sets forth the effective date.
JUSTIFICATION : This bill would help protect the health of children
in the State of New York by banning the use of any urinal or toilet
deodorizers containing paradichlorobenzene in all public and private
schools. Paradichlorobenzene (also known as 1, 4-dichlorobenzene or
p-DCB) is a toxic chemical known to cause headaches, blurry vision,
tremors and other detrimental health effects including damage to the
kidney, liver and nervous system. In addition, a number of health
agencies and coalitions have designated paradicholorobenzene as a
possible carcinogen.
Recent reports have revealed that deodorizers containing
paradichlorobenzene were utilized in firehouses in NYC where
firefighters were experiencing many health problems. Consequently, the
chemical showed up in air tests in such firehouses where the
firefighters were experiencing a high rate of cancer.
There are alternate deodorizers widely available on the market that do
not contain paradichlorobenzene which have begun to be utilized more
and more. Erie County, New York now only uses para-free products
through their janitorial contracts and estimates that based on
purchases from the previous year, has prevented approximately one ton
of para-containing products from entering the environment. The New
York State Department of Corrections also does not advocate the use of
any toilet or urinal deodorizers containing paradicholorobenzene in
their facilities.
Based on the above, it is important that these products are not used
in any New York State schools where children could be exposed to
vapors that may make them ill and are a recognized possible
carcinogen.
LEGISLATIVE HISTORY : This is a new bill.

EFFECTIVE DATE : This act shall take effect on the first of July
next succeeding the date on which it shall have become a law.
